A lawsuit against Baruch College was filed by the Alpha Phi Delta Fraternity Inc. on Dec. 13 over the alleged suspension and harassment of members of Alpha Phi Delta at Baruch by the college administration. Administrators named in the complaint include CUNY Chancellor James Milliken, Baruch College President Mitchel B. Wallerstein, Provost and Senior Vice President for Academic Affairs David Christy and Vice President of Student Affairs and Dean of Students Art King.
The alleged suspension and harassment came after members of the Gamma Rho chapter were found to be recruiting new members from Baruch in April 2017, despite the moratorium on social Greek life recruitment, claims the complaint. However, Gamma Rho should not be subject to the moratorium, continues the complaint, as the chapter has not been affiliated with the college since it decided not to seek recognition from Baruch in the Fall 2015 semester. Previously, Gamma Rho had been chartered at the college since 1989.
The moratorium was enacted in the Fall 2014 semester in response to the December 2013 hazing incident that resulted in the death of freshman Chun Hsien “Michael” Deng by fraternity Pi Delta Psi. It was further extended to last until the Spring 2018 semester. Currently, no social Greek organization is registered on campus.
Three Gamma Rho members were suspended and will not receive their diplomas until June 2018, claims the complaint, and other members of the fraternity have had their accounts placed on hold or had experienced threats to do so.
The fraternity is seeking for Baruch to allow its members to continue its actions and stop “prohibiting them from associating in their social fraternity not recognized or affiliated with Baruch College,” as well as for the college to pay any costs or fees incurred from taking legal action.
